Terms of Service

These Terms of Service apply to all services provided by GB Systems UG (haftungsbeschränkt), Spitalhofstraße 82, 94032 Passau, Germany ("we", "us") under the brand GB Hosting. They apply to consumers and businesses alike unless a clause says otherwise.

Terms of the customer that differ from these do not apply unless we have agreed to them in writing.

The plans on our website are not a binding offer but an invitation to order. In the cart you choose a plan and billing cycle and enter your details; you can check and correct everything before you send the order. By clicking the order button you place a binding order for the plan, billing cycle and price shown in the order summary.

The contract is concluded when we accept your order, and at the latest when we activate the service. The contract language is English; we also correspond in German.

GB Hosting provides web hosting, domain registration, and related services according to the selected plan. What a plan includes is described on its product page and in the order summary at the time you order.

We guarantee a 99.9% network uptime.

Your data is stored on servers in Germany. We create daily backups as described for your plan. They let us restore our systems and do not replace your own backups of important data.

All prices are in euros. VAT is added where it is due; the order summary shows the net price, the VAT and the total before you order.

Fees are payable in advance for the billing cycle you choose (monthly or yearly). Shared hosting plans and domains are billed yearly. A voucher code applies to the first invoice only.

We collect payments through our payment provider Mollie by SEPA Direct Debit or credit card. Renewals are collected automatically in the same way.

If a payment fails or is reversed, we may suspend the services after a reminder until the outstanding amount has been paid.

Contracts run for the billing cycle you choose (one month or one year) and renew automatically by the same period unless cancelled. There is no minimum term beyond the first billing cycle.

You can cancel at any time with effect from the end of the current billing cycle. If you are a consumer, you can cancel a contract that has renewed automatically at any time with one month's notice. We can cancel with one month's notice to the end of a billing cycle. The right to cancel for good cause remains unaffected.

A cancellation in text form is sufficient, for example an email to support@gb-hosting.de.

When the contract ends, the data in your hosting account is deleted. Please back up anything you want to keep before then.

We register domains on your behalf through our registrar partner with the registry responsible for the extension. The registry's terms and policies also apply: those of DENIC eG for .de domains, and those of VeriSign, Inc. for .com domains. You become the holder of the domain.

Domains are registered for one year and renew automatically for another year unless cancelled as described in section 5.

A domain shown as available can still be registered by someone else before your order is processed, so we can only guarantee a domain once its registration is complete. You are responsible for making sure the domain you choose does not infringe anyone else's rights.

The customer is responsible for the content stored on our servers and must ensure it complies with German and international law. Spam, malware, and illegal content are strictly prohibited.

You must keep your access credentials secret, tell us without delay if you suspect they are being misused, and keep your contact and billing details up to date.

If content clearly breaks the law or endangers the security of our systems or other customers, we may block it, informing you where possible.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee.

For slight negligence we are liable only if we breach an essential contractual obligation (one whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely), and only for the damage typical of the contract and foreseeable when it was concluded. Otherwise, liability for slight negligence is excluded.

These limitations also apply to our employees and agents.

If you order as a consumer, you have the right of withdrawal set out below. Businesses do not have it.

Right of withdrawal

You have 14 days to withdraw from this contract, and you do not have to give a reason. The 14 days start on the day the contract is concluded.

To withdraw, tell us clearly that you have decided to do so. Write to GB Systems UG (haftungsbeschränkt), Spitalhofstraße 82, 94032 Passau, Germany, email support@gb-hosting.de or call +49 1575 1448698. A letter or an email is enough. You can use the model form below, but you do not have to.

Sending us your message before the 14 days are up is enough to meet the deadline.

Effects of withdrawal

If you withdraw, we pay back everything you have paid us. We do that without undue delay, and within 14 days of the day you tell us. You get the money back the same way you paid, unless you expressly agree to something else. The refund costs you nothing.

If you asked us to start the service during those 14 days, you pay for the part we have already provided. That share is worked out against the full price of the contract, up to the moment you tell us you are withdrawing.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside.

If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contract is Passau.

Should any provision of these terms be invalid, the remaining provisions remain unaffected.
